Welcome to PawSphere (operated by Caresphere Technologies Pvt. Ltd.). These Terms & Conditions (“Terms”) govern your access to and use of our website, mobile applications, services, bookings, consultations, deliveries, and any related offerings (collectively, the “Platform”).
If you do not agree with these Terms, do not use PawSphere. Using the Platform means you legally accept everything written below.
1. Definitions
- “Company” / “We” / “Us” / “Our” refers to Caresphere Technologies Pvt. Ltd. and its brand PawSphere.
- “User” / “You” refers to any visitor, customer, pet parent, vendor, or service provider using the Platform.
- “Services” include but are not limited to online vet consultation, home vaccination, home grooming, pet food delivery, pet mating services, and any future services introduced.
- “Pet” refers to any animal registered or serviced through PawSphere.
2. Eligibility to Use
- You must be 18 years or older to use PawSphere.
- You confirm that all information you provide is accurate, complete, and truthful.
- You are legally permitted under Indian law to enter into binding contracts.
False information = immediate suspension without notice.
3. Scope of Services (Important Disclaimer)
PawSphere is NOT a veterinary hospital. We are a facilitation and service platform.
- Online consultations are advisory in nature and do not replace physical examination.
- Home services depend on availability, location, weather, safety conditions, and third-party professionals.
- We do not guarantee diagnosis, cure, or treatment outcomes.
You accept that all pet-related decisions are made at your own risk.
4. Medical & Health Disclaimer
- Veterinary advice provided via PawSphere is based on information shared by you.
- Incomplete, false, or delayed information can lead to incorrect advice — we are not liable for this.
- In emergencies, you must immediately visit a physical veterinary clinic or hospital.
PawSphere is not responsible for pet injury, illness progression, or death due to delayed or incorrect action taken by the user.
5. Booking, Scheduling & Service Limitations
- Appointment slots are limited and subject to confirmation.
- We reserve the right to reschedule or cancel appointments due to:
- Unavailability of staff
- Safety concerns
- Incorrect address or contact details
- Force majeure events
Repeated no-shows may lead to account suspension.
6. Payments, Pricing & Taxes
- All prices are displayed in INR unless stated otherwise.
- Prices may change without prior notice.
- Payments must be completed in full before service delivery unless explicitly allowed.
- Applicable GST or taxes will be charged as per Indian law.
Failed or reversed payments may result in service cancellation.
7. Refund & Cancellation Policy
- Refunds are not guaranteed and are evaluated case-by-case.
- No refund for:
- Services already delivered
- Missed appointments due to user unavailability
- Dissatisfaction without valid evidence
Any approved refunds will be processed to the original payment method within standard banking timelines.
8. User Responsibilities (Read Carefully)
You agree to:
- Provide correct pet details (age, breed, health history, vaccination records)
- Ensure a safe environment for home services
- Handle pets responsibly during service
PawSphere is not liable for injuries to pets, staff, or property caused by aggressive, untrained, or misrepresented animals.
9. Pet Behavior & Risk Acceptance
Animals are unpredictable by nature.
By booking services, you acknowledge that:
- Bites, scratches, stress reactions may occur
- PawSphere and its staff are not liable for behavioral incidents unless proven gross negligence
You accept full responsibility for your pet’s actions.
10. Third-Party Professionals & Vendors
- Vets, groomers, delivery partners may be independent contractors.
- PawSphere is not responsible for their personal conduct, delays, or actions beyond contractual scope.
Any disputes must first be raised with PawSphere for resolution.
11. Intellectual Property Rights
- All content, logos, designs, text, images, and software belong to PawSphere.
- You may not copy, reproduce, distribute, or exploit any content without written permission.
Violation may lead to legal action.
12. Platform Misuse & Prohibited Activities
You must NOT:
- Abuse staff or professionals
- Post false reviews or defamatory content
- Attempt fraud, chargebacks, or system manipulation
- Use PawSphere for illegal activities
Violation results in permanent ban and possible legal proceedings.
13. Reviews, Feedback & User Content
- Any reviews or feedback submitted may be used for marketing.
- We reserve the right to remove misleading, abusive, or fake reviews.
You waive ownership claims over submitted content.
14. Data Privacy & Security
Your use of PawSphere is also governed by our Privacy Policy.
- We take reasonable steps to protect data
- However, no digital platform is 100% secure
We are not liable for breaches beyond reasonable control.
15. Limitation of Liability (Critical Clause)
To the maximum extent permitted by law:
- PawSphere shall not be liable for indirect, incidental, or consequential damages
- Total liability shall never exceed the amount paid by you for the specific service
This applies even if we were advised of potential damages.
16. Indemnification
You agree to indemnify and hold harmless PawSphere, its directors, employees, and partners from any claims, losses, damages, or legal costs arising from:
- Your misuse of the Platform
- False information provided
- Violation of these Terms
17. Service Suspension & Termination
We reserve the right to:
- Suspend or terminate accounts without notice
- Deny services to any user at our discretion
Especially in cases of abuse, fraud, or policy violations.
18. Force Majeure
We are not responsible for delays or failures caused by events beyond our control including:
- Natural disasters
- Government restrictions
- Internet or system failures
- Pandemics
19. Modifications to Terms
We may update these Terms at any time.
Continued use of PawSphere after updates means you accept the revised Terms.
20. Governing Law & Jurisdiction
- These Terms are governed by the laws of India.
- Any disputes shall fall under the exclusive jurisdiction of courts in Patna, Bihar.
